1. Agreement & Parties
These Terms of Service ("Terms") govern your access to and use of Orchyn ("the Service"), operated as an end-to-end marketing harness for managing store listings, brand playbook mining, search-grounded query trends discovery, and creator fleet publishing workflows. By creating an account, setting up a workspace, or using the Service, you agree to these Terms. If you represent an organization, you agree to these Terms on behalf of that organization.
2. Scope of Service
Orchyn provides tools to connect product store listings, mine brand playbooks from app store reviews, query niche trends using search grounding, draft campaigns with proactive AI story assist, and coordinate influencer fleets. The Service is intended solely for business, commercial, and operational use. You are responsible for ensuring your campaigns, publishing workflows, and creator interactions comply with each third-party social media platform's terms of service (TikTok, Instagram, YouTube, X, and others).
3. Billing, Fees & Stripe Processing
Access to Orchyn's premium marketing harness features requires a paid subscription plan (Starter, Growth, or Scale). Subscription details and pricing are outlined on our landing page and Settings portal.
- Stripe Payment Processor: We use Stripe, Inc. ("Stripe") as our third-party payment processor for credit card transactions, invoicing, and billing management. By subscribing, you agree to Stripe's Services Agreement. Card details are transmitted directly to Stripe; credit card numbers are never stored on our servers.
- Billing Cycles & Auto-Renewal: Subscriptions are billed on a recurring monthly basis from the date of activation. Auto-renewal is enabled by default. Your card on file will be charged automatically at the start of each billing period unless cancelled.
- Cancellation: You may cancel your subscription at any time directly through the Settings dashboard under the Billing tab. Cancelled plans will remain active until the end of the current billing cycle, with no partial refunds or credits.
- Fee Changes: We reserve the right to modify subscription fees with at least 30 days prior notice. Continued use of the Service after the effective date constitutes acceptance of the new fee structure.
4. Customer Content & Playbooks
You may store influencer fleet configurations, app reviews, extracted brand playbooks, social media assets, and post schedules in Orchyn. You retain ownership of all customer content. You grant Orchyn a limited, non-exclusive, royalty-free, worldwide license to host, process, and display that content solely to operate and improve the Service on your behalf.
Mined Review Guidelines: When mining app store reviews to generate playbooks, you must respect the rights of reviewers. Generated listings and assets suggestions should not contain copyrighted or trademarked information belonging to third parties without permission.
5. Influencer Fleet Coordination
Orchyn enables you to onboard and coordinate both human creators and AI personas ("fleet influencers"). You acknowledge that Orchyn is solely a coordination workspace. You are responsible for executing independent contracts with human creators, obtaining necessary commercial release agreements, declaring advertising disclosures, and complying with local labor and intellectual property laws.
6. GDPR (RGPD) Data Processing Addendum
To the extent that Orchyn processes personal data on your behalf (such as influencer emails, social handles, or workspace members data) originating from the European Union, European Economic Area (EEA), or the United Kingdom, both parties agree to comply with the General Data Protection Regulation (GDPR/RGPD). Orchyn acts as the Data Processor, and you act as the Data Controller. Our processing details are governed by our Privacy Policy.
7. Disclaimers & Limitations
The Service is provided "as is" without warranty of any kind. We do not guarantee uninterrupted execution, error-free publishing runs, or specific conversion rate increases. Orchyn's aggregate liability for all claims relating to the Service is limited to the amount paid to Orchyn in the twelve months preceding the event.
